The reason why the President of the Republic, Marcelo Rebelo de Sousa, cannot dissolve the Legislative Assembly of Madeira at this time is related to the fact that it is still in the six-month period since the last election.
According to the law, the head of State is responsible for dissolving the Legislative Assemblies of the autonomous regions, but in this case, if he decides to do so, he will only be able to decree it from March 24th, six months after the election of the current Regional Assembly of Madeira , in the elections of September 24th.
Meanwhile, the president of the Regional Government, Miguel Albuquerque, announced his resignation from his position after the meeting of the PSD Madeira Political Committee following the investigation in which he was accused of corruption. The PSD-Madeira Regional Council will meet next Monday to name his successor.
After this announcement, the President of the Republic said that this would mean the fall of the regional executive, but again refused to anticipate scenarios regarding the eventual dissolution of the Madeiran parliament.
Still in the aftermath of the situation, Marcelo stated that he does not take a position on the political future of Madeira to give the regional parliament the possibility of approving the regional budget between the 6th and 9th of February.
Although the President of the Republic does not have any power in relation to a possible dissolution, leaving the way open for the PSD to choose a new leader, his position was criticized compared to what happened at national level, when Marcelo announced the dissolution of the Government socialist, which would only be made official after two months, to give time to approve the State Budget, and called early elections for March 10th.
